Today we're going to discuss a very important, I would say controversial, but I don't know if it's mamish controversial, but it's definitely a big issue, especially in yeshivas. The issue is eating before tekias shofar. Most yeshivas, I don't know about here in America, but I know in Eretz Yisrael for sure they do this, right before tekias, Kiddush. Everybody makes Kiddush, and everybody brings their little cakes over there, honey cakes, it's Rosh Hashanah, honey cake, and they go to tekias shofar. Now there's a very big shaila in halacha if this is the right thing to do. Like I tell you, many yeshivas do it. Many yeshivas do it. They must have a reason to do it. So first we're going to discuss why not, because the why not is a lot stronger than the why yes, a lot stronger. And that's the starting point, because l'choira pashut it's not. And why pashut it's not? Because the halacha is that before you mekayem a mitzvah, you're not allowed to eat. Then we're going to try to understand maybe, maybe why yes. So first let's get to the why not. In Tur, siman tof reish nun beis, se'if daled. If you want to look it up in Shulchan Aruch, you can find it in tof reish nun beis, se'if daled. Who wants to read? Go ahead. Gershon, but read clearly. Come, let's be clear. Go ahead. Asur le'echol. Asur le'echol. Kodem sheyitla. Not allowed to what? Eat before you take a lulav. Torah breaks it down. You want to move the Torah ahead? We do. Torah. Okay. The Shulchan Aruch is quoting what? Go look at the Be'er Hagolah. Who is he quoting? Not Mishnah Berurah. Be'er Hagolah, who is he quoting? Gemara Megillah. Okay, so the mekor of it is a Gemara Megillah. You can trace it all the way back to the Gemara Megillah through the Tur to the Shulchan Aruch. Isn't it interesting, rabosai, that there's a halacha that you're not supposed to eat before you mekayem mitzvos. Why is it only found, only found, in the Gemara, and in the Tur, and in the Shulchan Aruch, by lulav? L'choira, if you want to be mizdakek honest, if it says it only by lulav, maybe it's only by lulav. But then you'll say, but it's a chiluk. Why should lulav and esrog be different than any other mitzvah? Yutz anisht. What is it? Why is it? It's a kol yom. I'm asking, so the question is why only by lulav is it mentioned? A dilma lav davka. That's the two ways to look at it. So take a look at the Mishnah Berurah, se'if katan zayin. Asur lechol, v'teima v'alma, l'dina shari. Teima though is mutar. Continue. B'chol makom, ein na kilbazeh. Im lo l'tzorech. Now, don't make it into a light thing. It's a serious thing. Mishnah is going to come and say this shiur, you didn't eat, yeah, you didn't eat, you didn't eat. It's not a poshut zach. The Shmurah is telling you, and we'll soon see the Mizup all the way up to the Gedolei HaAcharon, the poskim, that this is a serious halacha. Until we reach to the Beis Meir, Beis Meir on Shulchan Aruch, siman tof reish nun beis, taka paskens asur. Asur le'echol, v'asur lita'om. You're not allowed to eat, and you're not allowed to taste by any mitzvah d'Oraisa. If you're going to be mekayem a mitzvah d'Oraisa that day, before, no eating, no teima, no tasting. The Shmurah tells us, eating, no; teima, yes, but even teima.

Ein lo hak. Go ahead, read. Read it better. No, go ahead. No, no, no, no. Say it again. Say it again. So teima, meaning eating is aser. Teima is mutar, but ein lo hak. Don't be light. Im loi, unless it's a need. Now what do you call a need? Torah gadol, big need. What do you call a big need? Some people need to eat. I need cake. I need snack. I need steak. That's the need that we're referring to. So if you look at the Chayei Adam, you look at the Mateh Efraim, which, like I told you, Mateh Efraim is the mekor for all hilchos Rosh Hashanah and Yom Kippur, the poskim, chalishus, not choli, chalishus. Now I want to be very clear with you. There's a chiluk between choli and chalishus, and I'll tell you why. Because many poskim say that today we're weak, not sick, but we're weak. So remember, it's not choli. You look at the Chayei Adam, you look at the Mateh Efraim, v'chulei v'chulei. The issue is not choli, but chalishus. And today some say that we're all chalishus and we're weak, shmweak, weak, weak, weak. Okay. Now, what are you allowed to eat? Teima, but achilah is aser. Oh, what's called teima? Slowly, what's called teima? You know, there's a lot of types of teima. The Gemara tells us that a woman could be to'em on a fast day to see if the macholim are good. And we spoke about this in the poskim, like yom Yom Kippur, taste by the tip of the tongue, not to swallow. Teima. Everybody has a different geder what teima is. For example, you ever see, Can I taste your soda? So it depends who it is, right? Because if it's a regular person, you give a taste. Some people, you know, when they say, Taste, you have to soda. Everybody, everybody has a different hagdarah to teima, right? Here it doesn't say. What is the point of this shiur? Let me tell you what the point of this shiur is. I want to teach you, you and you and you and everybody, that the same way you learn Gemara, please learn Shulchan Aruch. It's the same thing. Analyze the information. Learn what it says. So remember, there's Gemara Megillah. Now, I would have started with the Gemara Megillah if it was a Gemara shiur, but it's not. So I start with the Shulchan Aruch. The Shulchan Aruch is by lulav, by lulav and only by lulav. The Tur is by lulav, quoting the Gemara Megillah. That's a beraisa. Now, if you want to learn the sugya biyun, you'll go to Megillah, fine. But in Shulchan Aruch, it's by lulav. Torah by lulav, and the question is why only by lulav? Or maybe it is only by lulav, and if it is only by lulav, why would it only by lulav? L'choira it should be by everything. Second point, let's see the Mishnah Berurah. Mishnah Berurah says two statements: Achilah asur, teima mutar. Okay. Teima mutar, achilah asur. First of all, why? That's the next thing you have to ask. What's the reason for this halacha? We'll soon see. V'hu she'mekavein, we'll soon see the reason for the halacha. We'll soon see. Al kol panim, the next thing we have to clarify, unless there's a tzorech gadol. What's called a tzorech gadol? So I explained to you, you look at the poskim. It doesn't mean chsick; it can mean chalishus. Next question: what's a teima? These are all unknowns when you learn this halacha. Lulav, why only lulav? Asur le'echol, why? Teima, what's called a teima? Tzorech gadol, what's called a tzorech gadol? Have we analyzed the information? Yes. Fine. That's how you're supposed to learn a Mishnah Berurah. Achilah and shtiyah is the same thing, usually. Usually. Stam it means the same thing here too. Okay.

I'd like to send you now to another Mishnah Berurah, where the Mishnah Berurah discusses it by other mitzvahs, so he'll take care of the issue: is it only by lulav? And the second thing I have from that Mishnah Berurah is what's called a teima. Who decides what a teima is? Is it my teima or your teima? Is it your buddy's teima, or is it your father's, your parents' teima? My father has to taste the son's food, it's a drop, but if your friend takes, he takes half of it, like I told. So let's see the Mishnah Berurah, siman tof reish tzadik beis. Two of them: one se'if katan yud-daled and one se'if katan tez-vav. ... This is interesting. Interesting. Good stuff. Se'if katan yud-daled and se'if katan tez-vav. Go ahead, read it. ... Okay, now what is he going back on? Oh, not allowed to what? Eat before Kriat Shema. Now we have a second place that it says, Kriat Shema. So it's not a universal din now anymore, lulav, meaning it's not specifically lulav. It's not universal, asur le'echol kodem kol mitzvahs. We have another example. What? What would be the reason behind it? I didn't get there yet, but the reason behind it is because you might come to forget, and you might come to not do the mitzvah. Which one you want to know? It is top reish tzadi beis. By Chanukah? By Chanukah, so it's fine to me. Also. Go ahead. I show you if it doesn't say it? No. So it's interesting. Some places it decided to say it. Some places it doesn't say it. So now we have a shaylah again. Maybe it's only Megillah. Maybe it's everywhere. We find it by lulav. We find it by Megillah. Now if it's one general rule for all mitzvahs, just say all mitzvahs and that's all. Ela by each specific mitzvah has to be taught. So where it's taught, fine; where it's not taught, not fine. Shofar doesn't say. Is that a fear hara? If it's lulav, which happens to be the mekor. The mekor is by lulav. So the Mechaber says, hu hadin Megillah. All right, hu hadin Megillah, fine. We'll soon see tefillah also. I'm going to talk about tefillah. But is it kol hamitzvos? Do you find anywhere in Shulchan Aruch that it says, lifnei kiyum kol hamitzvos asah lecha? No. So then the pshat is, it's not a universal halacha; it's every case. So you could come and say that it's a pashut that it's in every case. So just say it in one: lulav, and we'll learn lulav everywhere. Teretz is it's by lulav, and it has to be told also by Megillah. So why does it not have to be told by shofar? Unless maybe by shofar it doesn't apply, which I happen to hold is true. I hold this din doesn't apply by shofar, and that's why it's takanah by shofar. According to the Shulchan Aruch, he did not feel the need to write this by shofar. Because as we soon will explain, put that away, as we soon will explain, it doesn't apply by shofar. And the question is, why not? Why is shofar less of a mitzvah, more of a mitzvah, or different of a mitzvah than lulav and megillah? Al kol panim, at least we have an answer to question number one. Is it only lulav? No. It's also megillah. But is it only mitzvahs? I don't know. Maybe. It's not so pashut, because then why would you not say it by shofar? Read the Mishnah Berurah now. We're getting there. Sif katan yud-daled, sif katan tes-vav. Oh, so this Mishnah Berurah is this. Go ahead, this... So actually the Mishnah Berurah by lulav, is this Magen Avraham here? Go ahead. No. Sure.

Shalom aleichem. See what's going on over here? Now you know that I know how to learn. Do I know how to learn, or do I hack you a chaynik? You hear where I'm going with this? Of course you know where I'm going with this. So let's—like Kriyas Shema. Beautiful. What's the reason? Shema yachtifenu sheinah. Wait a minute. So then Megillah we're toch manah by day, we're toch manah by night. So then it doesn't apply by day, maybe? So then we don't even have a makor for Megillah either. Why not? Now we're back to only one place. What's the reason by Megillah, like by Kriyas Shema? Kriyas Shema—what about all the mitzvahs? Teretz is we're not talking about that din of not eating before all the mitzvahs. Why not? And the answer is that's not what the Mechaber—because there's no such din, maybe. No. Shema yachtifenu sheinah is at night. This is a different—unless shema yachtifenu sheinah is by day too, you'll eat so much you'll fall asleep. I don't know. You just can't eat because before davening anyways. Ah, you hear what he's saying? No, no, no, he's saying very good. He's saying not bad. He's saying maybe not bad. Since you're eating the Megillah after Shacharis, and you're not allowed to eat anyway before Shacharis, therefore we don't need a special din. Wow. Oh, he writes here. Continue. What does he write here? Shh. What does he write here? V'da. Ah. Ah. Oh. And then the whole taam Hashem yachtifenu shinah doesn't apply. So you stop just saying, I'll eat in front of any mitzvah, and that's all. But that's only by night. Oh, you're saying by day. He's being meayer, Mishberurah is saying, wait, wait a minute. The svara only applies by night. Oh, no, no, no, no. Chak. Maybe just like it's possible you'll forget there. That's what I'm saying, unless they have the same reason. Yeah, unless you learn like that. I want you to know that the Esh Lavram, Butshatcher, many poskim, talk and say that this is not because it's night. What do you have from Megillah? What do you have? It talks about night. Night is not the heter to us. Mishabrurah sticks in, and it is the heter to us, because hu adin, hu adin by day. Maybe for your reasoning, or maybe not. Maybe stam hu adin by day. That he doesn't say. He doesn't say that by day the reason Hashem yachtifenu shinah. Could be we meant to say it's hu adin, this is not negea to day, but rather by day you have a different issue. Like Kriyas Shema is what? Ba... nu, ba... layla. By day is a separate sugya. It's a separate... Maybe, again, we're trying to understand what the Mishnah Berurah means. Either the Mishnah Berurah means that the Hashem yachtifenu applies by day also, because it doesn't mean mamash shinah; it means Hashem yachtifenu shinah, and by day Hashem yachtifenu business. It doesn't have to be shinah, shinah. It's not about sleeping, or unless he held that if a person eats a lot by day, he'll taka fall asleep. Maybe. If you eat a big seudah, you'll fall asleep. Maybe, maybe. Okay, okay, okay, okay. Everybody has what to say. You're saying very good. According to the chein Hashem yachtifenu shinah, te'imah has no shaychus. Thank you so much. Thank you, thank you. If, ... doesn't mean sheinah; it means you'll be busy eating. By teima, busy eating. No, but I've been ... papuram, you can fall asleep. If you're so drinking. So the answer is, we're not tolin it as k'mo sheyafru lulavis says. He says, k'mo sheyafru lulavis says, sheyafru. You're not going to drink and fall asleep by sheyafru. What do you want? Someone tell you again. Teima, even teima is l'chatchila not allowed. The taam is shem yachtifenu sheinah; when you taste a bite, you're going to fall asleep. Why? We're not afraid you may drink. You're not listening. You're not listening to what you yourself are saying. If it's out even teima, ro'ui l'chachamim, says the Mishnah Berurah, so why is there a halacha בכלל that ro'ui l'chachamim? What do you mean machmir about? For what? Unless you say efshar. Since they asser achilah, so lomdus shavar. Since they asser achilah, teima is nichlal in achilah l'chumra. Try not to. But it's not that the teima is the problem. You're not going to run into a problem. They asser achilah. We'll do it in a minute. They asser achilah.

We need to listen to— I know, I know, but listen, Klal, what we're doing here. Read, you can read on your own. Everybody knows how to read. The question is how to read. Could be the taiches teima is not a problem, but teima is a problem because once you asa achilah, then, then— nichlal. Teima l'chatchilah, better not to have even a teima. What's called a teima? Now you continue reading, which is our Mishnah Berurah here. Go ahead. What? What? What? That a chalishus hachilah ktzas. Oh, oh, oh, oh, yeah. Oh. Hard. But anyway, Taanis says, if you're fasting— but here you don't really have it so much. Maybe it's the same yesod, chalishus. All right, I'll let you get away with it. Go ahead, nu, weiter. Right, because you're fasting, so it's hard to fast the whole day, but in the morning Rosh Hashanah it's not the same thing. All right, we'll see. Go ahead, yeah. Oh, what's called teima? What's called teima? Yeah, and the answer is— pat. Oh, pat. Oh, what? Mashkin? You wanted a question, shtuyah, you wanted? He's answering. Oh, shtuyah, what? Pat. Okay. You want me to repeat it because I see you didn't— You want me to say it over again like this? Tell me something. Tell me something. Pat? You talking about pat? Okay, I'm not going to leave you with this because I'm going to show you another Mishnah Berurah. But before I show you this other Mishnah Berurah, please turn on the air conditioner. Please get me some water. The Chofetz Chaim said, ask the dibuk, what do they hold of the Chafetz Chaim and Shamayim? The answer: k'tana b'yama. So just like the Tannaim have to be learned b'iyun because they spoke in ruach hakodesh, so too if the Mishnah Berurah has spoken ruach hakodesh. Now— What? Everything is written. Everything that the Chofetz Chaim said was b'ruach hakodesh. Now. Okay, so let me tell you again. Understand that there's a sugya here which is not 100% clear. It's by lulav, ... it's all mitzvos. What are you talking about lulav? The teretz may be it's also by other things, so we find it by Megillah too. We don't find it by shofar. Why not? Mishnah Berurah says it's by shofar too. Yeah, maybe. It's not there. It's not ... by shofar. We find it by Kriyas Shema. Kriyas Shema is a little different. Kriyas Shema, shem yachtifenu sheinah. Mishnah Berurah says yes, the din of Megillah, shema yachtifenu sheinah, so then it doesn't apply to the day. It also applies by the day. You said? Mishnah Berurah said, okay, fine. Maybe shema yachtifenu sheinah is the same thing like you leave, you'll forget. Okay, same thing. It doesn't mean sleep-sleep, or maybe ... fall asleep. All right. What is teima? Teima. So what is called tzaras? We'll see here we have a little bit different than just chalishus, cholik, ktzas, and mi shekasher lo, he can't be עומד בתענית, maybe that's chalishus. All right. What's called teima? Pas. What's the shiur again? Pas. That's called teima? To me that's called a seudah. That's called k'seudah shleimah b'shait, especially in yeshivas, when they ration the bread and the tomatoes, so it's k'seudah shleimah b'shait. So, rabosai, I'd like you to do me a big favor and take a look at the Mishnah Berurah, siman reish lamed beis, se'if katan lamed daled. Get into the air of... siman reish lamed beis, se'if katan lamed daled. Se'if katan lamed daled, katan lamed daled.

First of all, tell everybody what's going on. Read the top. When, when? Where, what? By what case? Minchah. This is for daf. You're not allowed to eat before daf. People don't know this. Oh, seudah ketanah is asur when you kovea seudah. What's called a kovea seudah? Te'imas achilas peiros mutar. It gives you a shiur there also. Read the rest, read the rest. Oh, pat kebeitzah. Below. Okay, so who's talking now? Hamechaber. So the Mishnah Berurah there is the Mechaber here, right? He's not saying anything more than what the Mechaber said, right? Peiros or pat kebeitzah. But, says the Mishnah Berurah, sif katan lamed daled. Yeah. A lot of kemeiros, go ahead. Oh, tavshil made of hei minim. So we're talking about cake now. So when we said pat, what did we mean by pat? Bread. Bread. Mashen kein cake, cake, how much could you eat? As much as you... that's called a te'imah. He's already preparing the honey cake for before the tekias shofar. You don't have any case. They don't let. Oh, they דאם feasting, so we have to talk about that. About twelve. We want to discuss that. That's one of the topics that we have to discuss. Yes, questions if you're allowed to do that. A lot of feast under ... You don't like that. You better get ready. Bi'al ha-poil, you'll be doing that. You better get ready for bi'al ha-poiler, because bi'al ha-poiler you're going to be doing that. Okay, now listen carefully. Mishnah Berurah says it clearly, that when we say פת שולחן ערוך, no, we mean bread, because chametz ... you can have as much as you want. Then the coming point where after eating a certain amount of bread— The only question is, do we call cake a tafshil? That's what it means by tafshil. But if you're kovea seudah— but if you're not kovea seudah, eat and eat and eat and eat, yisover the din is kovea seudah. So then it would be a problem if you're kovea seudah, what? No? That's what it says. It says that that's called good teima. That's okay. Teima is פירוש, I mean, teima is פת כביצה. Tafshil, eat as much as you want. Peiros, as much as you want. Bring out the seudah, the seudah, the seudah is coming before the kiyus. You're matir it. Teima is mutar, unless you want to say it's not ... because the ... can handle it. It can't handle it. Ah, what do you do with the beis meir? Beis Meir is ... The Beis Meir that comes and says that you shouldn't even be to'em. We don't pasken like this Beis Meir. We pasken like the Mishnah Berurah, that the Mishnah Berurah says, well, it's allowed. So, b'hainu, we don't even know if it applies by the kiddush. Maybe there's no such din by the kiddush. Mishnah Berurah tells us it is. Okay, we'll grant it to him. He knew better than us. I don't know where he got it from, but he knew it better than us. Even if it is, there's a din of tzorech, what's called tzorech, let's say chalishus, according to the Mateh Ephraim, and we'll say that that's what Mishnah Berurah means, misanetz. Two hours to fast all day, two hours to fast till three o'clock in the afternoon, too hard to daven. It's too difficult to daven in such a chalishus, and you're allowed to have teima. Finished. So you're allowed to have what? What? So read it, read it. Mashke, yeah. You'll have problems like the wine. If you want to make kiddush on wine, you shouldn't be drinking too much. That you might have a problem. Okay. Right.

Stop mashke as much as you want, as juice, keep drink away. Okay, so now we've established, vadai is supposed to what, rabosai? Eat before tekias shofar. I'll tell you why. If you're davening until three o'clock, loch is you're not allowed to fast on Yom Tov. V'achalta lifnei Hashem. Now, we have to clarify for the Shachnas Aryeh and all the other acharonim, maybe there's no din of chatzi lachem, chatzi laShem, because it's a din in Simchas Yom Tov, and there's no din simcha maybe on Rosh Hashanah. But, told you all with the Rambam, it's not a taanis of simcha yeseirah, but a ... simcha there is. It's machlokes haposkim. The Rosh says clearly, simchatchem b'Rosh Hashanah. You see, le'inyan taanis also. You can do whatever you want. But she's not going to be dying. No, but if you're hungry, come, order an aruchah, take. Right. It's not going to help you until three o'clock. You're hungry. The olam is hungry. But we're not talking about a taanis. Taanis is Purim. I'm giving you an example, chalishus like we discussed, Purim taanis. Are you talking about for the problem of ...? Yeah. We see by Erev Rosh Hashanah we don't say Tachanun by Mincha. Mei'lo what? Erev Rosh Hashanah, because it has a din of Yom Tov. We say slichos in the morning, we say Tachanun. No, it's a shaila, it's a shaila. Okay, let's move on. So then the question becomes, yes, allowed to not eat till three o'clock. For example, I, my dad, we don't eat till two, two-thirty, three o'clock, we don't do it. So maybe I'm doing something wrong. I'd like you to look at the Mishnah Berurah, siman taf kuf tzadik zayin, se'if bais, in the name of Ateres ... Taf kuf tzadik zayin, se'if ... Im mutar l'sanes b'Rosh Hashanah. Are you allowed to fast on Rosh Hashanah? Go ahead. You're not allowed to fast on Rosh Hashanah. Go ahead. Tell me, forget it to you, because you probably want to fast on Rosh Hashanah, two days. Well, Yom Kippur you might have to fast two days. It's a fake day. Many people did it. Shanghai, Chiang Kai, they used to fast two days. ... they said fast two days. A lot of Gedolim fasted. I think I heard there were ... fasted two days. I'm talking about ... I don't know, big people used to do it. Who? The Chazon Ish said ... Yeah, he said which day is Yom Kippur. That's different. They wrote him and he said which day is Yom Kippur. Okay, go ahead, let's go. Okay, continue. Right, but you can't sit there and then make it into a big feast. Go ahead. Update. Mister ... when, when is that? ... Can make a ...? People are ... He needs to say is ... Yeah, ... Go ahead, yeah. Yeah. ... שמחת בחגך ... So Mishburah is paskening there's a din of simchas Yom Tov. Go ahead. חג. Yeah. תיקו בחודש, תיקו בחודש. ... Go ahead. Right. ... Hashem is your ... ... כי קודש היום לה'. Go eat good foods because today is ... Next. Go ahead. ... Continue, continue, continue, continue. Get to fasting during the day. Nu, come on, nu. ... Continue ... Rosh Hashanah ... עד חצות. I said it so quickly, ... Problem is ...

Ad chatzos, go ahead. Yeah, passuk, go ahead. Now, what does mishber mean? He means that you're latafes till chatzos, so he means that till chatzos you're latafes. Read it again. No, because you can read it like this: you don't have the problem of till chatzos. Meaning what? That you don't have that problem, or till chatzos and then you got to stop. You had the chatzos in a minute? Yeah. There's two ways to read it, because the problem is the davening. The yeshiva should davening. You davening till three o'clock, what do you do now? Then he meant to say is keep on going. Did he mean till chatzos, or did he mean don't worry about chatzos? Why wouldn't he say passuk? I don't know, but he says a bashmoyos, which could be learned two ways. Okay, it's so interesting. Okay. So listen carefully. I'd like to read you Maaseh Rav from the Gra. But before I read you the Maaseh Rav from the Gra, I'd like you to read the Biur HaGra on the Rama, tof kuf pei daled, se'if aleph. I want you to read it. You have it there? Read it. Read it good. Read it. Get into it. Come on. Just because I'm making it interesting doesn't mean you got to talk. Don't talk. Ur HaGra on the Rama. Certain talking is for outside. No. No, no, ... Good, that's the... Oh, what does it say there? ... Chatzos. ... Till chatzos. Who says that? Rama. Say it's Rama. Says the Gra, ... meaning, what does he want? Till chatzos, because of the chamya, which means the din of a chilul hashman means you're allowed to eat till chatzos. ... What? Also see, Rosh Hashanah, ein marichin b'tefillah yoser midai. Says the Gaon, too much is too much; it's no good. You hear? Now... yeah. Ad chatzos—I'm sorry, she'ein lisanis bo ad chatzos, says the Maaseh Rav. This Gaon, Shulchan Aruch, because you're not allowed to fast till chatzos. That's it. V'im nimshach ad chatzos... What happens if it gets till chatzos? You have another problem. What's your other problem? You're not allowed to eat before Mincha. V'im nimshach... that's why they davened ne'ilah, they davened Mincha. Wow. A lot of yeshivas, they'll daven, and then they daven Mincha. Why? They get it over and done with so they can go to sleep. That's not... You're not allowed to eat. ... After chatzos, now you're in trouble after chatzos. So what do you do, says the Gaon, if you get till chatzos, you got to stop by chatzos. So I have a good eitzah: make the musaf into Mincha. Turn it into a Mincha, you know what I mean? Start, you know, Baruch, Chatah, Hashem, and then turn—just make it into... Okay, this is too late. Now, so if you take a look at the Magen Avraham, Taf Kuf Pei Daled, se'if katan daled. The Magen—two things. Last two things I said was like this, okay? What's the issue? The issue is, l'choira, we eat, you're allowed, right? Now I'm showing you not only it's a question you're allowed, you maybe have to if you have a long davening, because you're not... Mishnah Berurah—clear Mishnah Berurah that's matir. What does he matir? What? To forget about the din of chatzos, or he's matir till chatzos like the Gaon? It's the way how to read it. The Gaon is clear, it's till chatzos.

He's mechadesh tremendously, sayed maaser. Again, problem: Milcha should go down mincha. ... maaser Rav, she'ein מוסר ... chatzos. ... Where is ...? Not real good, huh? I say good. We're gonna get it. We're getting it, yeah? Stop דא ... and then דא ... So you stop, not eating. ... mincha, so you mess up. That's not good. If the problem is you're not allowed to fast till chatzos, so by chatzos you stop, then you go down to mincha, because also two-hour issues. Mincha Rishon is also an hour issue. So again, you don't have your chatzos. Where are you? What's wrong? Here the shaylah. The shaylah is ... What happens if you're down mincha by chatzos? ... What the ...? We can do this. Just eat before. And then you can daven Mincha by chatzos, so you're fasting anyway till after mincha. But you can do tefillah. If you see that obviously he's worried about the seudah, the seudah has to be before chatzos. So if you look at the Magen Avraham, says the Magen Avraham in siman taf-kuf-pei-daled, this is where the yeshiva is getting from, Yam shel Shlomo writes, don't worry about chatzos, you just keep on davening. But— Tefillas a piyutim in davening. Don't sit there and stay and practice your chazanus. Main thing is, you should be davening after chazanus. If it's just that the guy's yoshvel rozenblatting, you know, better, you're thinking about it, it's, mimkomcha, mimkomcha, mimkomcha, mimkomcha — that takes three o'clock. That you shouldn't be giving up your chatzos. Hey, what does it mean, the ... please? What's the ...? ... at least go to chatzos, אפילו longer. Yeah, you shouldn't be, shacharis in the morning, you shouldn't be out of shul at ten o'clock. ... and that's where the yeshiva is getting. I shouldn't? What about netz? Now, why does the olam — yes — why is it that the olam eats? So I just told you, I just told you, that if you take apart the halacha, there's no reason why not to eat. Aleph, you're not supposed to fast, according to most poskim, till three o'clock. So even the Mishnah Berurah that says don't worry about it, so maybe it's only till chatzos don't worry about it, not till three o'clock. Second of all, who says they're eating? That's not called eating; that's ta'ima. And there's chalishus and whatnot and so on. That's the basic halacha. Most people who learn Mishnah Berurah are not going to be medayek in every word like we did. More or less that's what you come out with. You know, eat anyway, and then, and it's — are you supposed to not fast? I want to talk about another cheshbon, why in yeshivas who are such frummer people... From a people, Yisrael people are machmir on everything, kala v'chamura. Why do they make an issue to eat? I have a few cheshbonos halacha that most people don't think. I want to introduce that to you. First of all, what's the reason why you are not allowed to eat? What's the reason for it? And the answer is shema yishkach. It's clearly, right? Maybe you'll fall asleep. Even if it's not sleeping, but shema yishkach, like the Mishnah, like by tefillah, right? You might come to forget, and you'll miss the mitzvah. You'll eat and not do the mitzvah. That's the shema yishkach. You look at the levush, that's brought down in the poskim, that's pashut. I mean, there's a kvius. The olam is going to krias shema now. What are you going to miss? There's a hundred people going out to krias shema, so they eat before, so on. If you're on your own and you're doing the mitzvah on your own, so you have a problem of shema yishkach. Where's the shema yishkach? The whole thing doesn't. If the sevara is shema yishkach, then it doesn't. So what is the issue maybe? Maybe the issue is because now it's coming to the mitzvah, you're not supposed to perform mitzvah. Maybe that's the whole issue.

Because if the issue is forgetting, I think let's see how it's historical. See, bishlama lulav and esrog. Lulav and esrog is the individual. You have to take lulav, you have to take esrog. Well, it's not so pashut, because by lulav and esrog the taich is that your front going to shul, unless maybe you don't go to shul. I'm trying to hear that lulav, okay. Chanukah, I hear you might forget to light, whatever mitzvah you're going to come up with. But by krias shema, where the olam is in shul and they're eating kiddush, so maybe, and a Chanami, if the person's beyachid, if a person's alone, and a Chanami, the sevara would apply more. But b'tzibur, the sevara doesn't apply. You can't have more than a shomer than this case. What's the problem? Shomer. You have a shomer. Everybody's going to eat, and they're going to go to krias shema. I have to go. Now I have to go. This is cheshbon number one, but I think it's kedai to infuse, inject into the sugya. Cheshbon number two I want to inject into the sugya, I'd like you all to look at Shulchan Aruch siman tof kuf pei ches, se'if aleph. Go ahead. Zman? Bayom. I want to identify with you and clarify with you: when is taka the zman of the mitzvah? If you say the zman of the mitzvah is the morning, so then you have an issue of eating before the mitzvah. I'm going to prove to you that actually the mitzvah doesn't start till Musaf starts. I'll show you how. Shulchan Aruch, it's in the top kuf pei ches, se'if aleph, mitzvos bayom. Go ahead and read. It says, bayom and not balaylah. Now I'd like you to read the Mishnah Berurah, se'if katan beis. Beis. Oh, so why do we do it later? Where is the dimyon, this reason like dimyon of mitzvos? If there's a mitzvah to blow shofar in the morning, bayom, as soon as the day comes, why do we wait till three o'clock to do the kind of mitzvah? Do you know that rule of an esrog? A lot of people, they take it before, as soon as they wake up in the morning. I take lulav and esrog in the morning. As soon as you wake up, you run to the sukkah and you take your lulav and esrog. Why? Because it's makdimin. Ella mai, then the wifes, you do it later. Good, good, good, you do that, the brachah, we're going to get to all that. But the point is the mitzvah is in the morning, and the naanuim is the second part. So how can we don't blow shofar right away, first thing in the morning? Go ahead. Kivan she'ein kol hamekiyin, not everybody knows how to blow. Ah, continue, continue. Okay, okay, continue. Tiknu. Look at the Sha'ar HaTziyun, that he brings that some gedolim תקעו in the morning. The Sha'ar HaTziyun brings from the Sha'arei Teshuvah that some gedolim... Wake up ... in the morning and blow. Why? ... Go ahead. Yeah, go ahead, read, Nu. Nu, sha'ar tziyin, nu, sha'ar tziyin b'shaar teshuvah. Read it again. Read it clearly. Oh, ... Even though there's din of ... mitzvahs, and he brings from Gedolim. He brings Gedolim ... I want to see ... Shaar teshuvah. Yeah. Oh. ... You hear? ... They used to blow shofar in the morning, here. They used to have people, ... here. They used to blow in the morning. Used to blow in the morning. So the question is, why taka don't we? Mishnah Berurah tells us because the chachamim were mesaken to do it by Musaf. So the zman of the mitzvah is taken out of the morning anymore. The chachamim taught me how to do it. So if I go and I eat before Musaf comes, maybe I'm not ...

I'm not eating before the zman of the mitzvah. Come and say, yeah, but I could daven Musaf any time. So, m'meila, if I could daven Musaf, so there's zman of Musaf here, so the chiyuv is already. Ay dilma no. It's when I daven Musaf is before and after, yoshev and amidah. I'd like you to look at a Biur Halacha, Hilchos Tefillah, siman pei tes, se'if pei, דיבור המתחיל צריך להפסיק. You like? You feel like you're reading the Mishmeres Chaim. If you read the Biur Halacha, Reb Chaim Brisker, gadol sheb'gedolim, siman pei tes, se'if pei, דיבור המתחיל צריך להפסיק. Go ahead, read the Biur Halacha. Go ahead, go ahead, go ahead, go ahead, go ahead. Yeah. ... כן, כן ... ... פסק ... ... צריך להפסיק. Pei. You have to stop, right? In other words, if you started, you have to stop. Within the half hour, Chazal, Chachamim said you're not supposed to eat. So that's to say, ... Go ahead, Nu. ... הכא, ... בבוקר, right? You shouldn't eat from alos hashachar. Go ahead. ... אפילו ... ... אפילו ... ... So it could be al tzd ... All right, it's not de'oraisa, so you can't stop from eating. But for the kriyas Shema that's in the davening, go ahead. ... Continue. Wait. Now slowly listen to this, and I'll show you how Baruch Hashem was mechaven hilchos shofar. So I just told you that since the musaf is the mitzvah, and the musaf is not here yet, so you don't have to worry about it. Listen to the Mishnah Berurah by davening in the morning. Listen to the lomdus. Since it's anyway not the right time to daven, even though you could daven, Chacham didn't say you should go right away and daven by alos hashachar. You could be yotzei b'diavad. So therefore, lo hichmiru that in case you want to eat, that you're not allowed to eat. That's the Gemara. If it's not the right way, even though the zman is here that you could daven, the musaf maybe is here already. You could daven musaf, but l'maaseh, l'maaseh, you're not davening musaf. Yes, that's what we're saying, that you're not eating. That's what I'm trying to tell you. That's what I'm showing you. Since even though he could, he's not. Now the only difference is here he's not because the halacha tells you that it's not. Here it's not because you grounded not; you're not holding it yet. But you see that could be where the not, even though the zman of the mitzvah is here already, if the seder of it is not for now to do. There's no issur of hachiluk, but read. I said it lomdus, that since the tekiah was supposed to be done al seider hamusaf, l'maaseh you're not holding by musaf. Even though technically mitzvas tekiah shofar is here already, but that's not how it's ... You could daven Musaf, but I'm not davening Musaf. The mitzvah is when I daven Musaf to have the tekios. So you could come and say, you see the same yesod a little bit, that since Kriyas Shema is going to be done al pi seder habrachos later, l'chatchilah dika way, even though mitzvas Kriyas Shema starts right away in the morning, lo yechmiru kol kach ta'aseh d'achilah. So even if it's his... Now, I want to tell you over a chidush halacha from the Esh LaAvraham Butchacher. There's two Esh LaAvrahams. One is Pri Megadim's, and one is Butchacher. That's how you should know, if you ever hear, paiskim, they'll talk, the Esh LaAvraham, they'll say Esh LaAvraham, period, or Esh LaAvraham Butchacher. It was the Butchacher.

Butcherov, the Eshlavram, it's the back of the Shulchan Aruch. You'll look, Reb Elazar, when he writes the Eshlavram butchatcher, he'll write on the side, Eshlavram butchatcher, because he was the butchatcher Rav, and this one, the groise posik, it's the back of the Shulchan Aruch. And you have to know, butchach, butchatcher Rav. Maybe, maybe not, I don't know, whatever, butchatcher Rav. Doesn't make a difference. Fine, I don't know. Okay, now. He says a meidge chiddush. You want to eat? Maybe the Eitzah, says the Butcher, in siman tav kuf pei ches, below shaifer, b'yoshiv, and then go eat, and then daven Musaf with tekios. Your problem is you're not allowed to eat before the tekios. He has a solution: go and blow tekios, now you're finished. Can I say a word? ... has to help me out today. Azoi zogt the Butcher, Eshlavram. A meidge chiddush. Why? You should have the tekios d'meyushiv, then you should eat, and then you have the tekios d'maumed. That's the right way to take care of the problem. A, you want to eat, you're hungry, ... whatever, whatever. Ah, you're not allowed before tekios shofar. Fine. So have the tekios shofar, the meyushiv, the first ones, then eat, and then you have tekios d'maumed. What's the chiddush of the Butcher? It's a big shaila in the poskim: what's the ikar tekios? Is the ikar tekios the meyushiv, or ... it's a big machloikes. Here's going to have to learn, and he speaks it out ... that the ikar is the meyushiv. Because the takanah of not eating before the ikur mitzvah. So he's just learning that the rest is al seider ha-tefillah for the sake of the musaf. So it comes out that the ikur is the miyushiv, and that's a big machlokes haposkim. That's a big ra'ayah. But this is the chiddush that the Buchacher said. I'm going to show you that actually someone said this way before the Buchacher. It's Rav Akiva Eiger, and I'll show you where it is. Okay. But you have to know, issue number one, that the kiyum is the miyushiv. He's learning, obviously, is the ikur, and that's not so pashut. Now I want to tell you a chiddush. If someone davens with a minyan vasikin, that was an early minyan, and he blows tekias d'meyushiv, now he wants to go to a yeshiva for musaf. So according to the Buchacher, it's gevaldik. What he does is fine. That's no problem. You're allowed to even make Kiddush and go later to musaf, to yeshiva. You're not mesaken. Have your tekias d'meyushiv, then you go eat, and then you split it up. It's not a big deal. What's the issue? What about the hefsek, right? You're making a bracha, having a hefsek. So let's discuss that. Look at Shulchan Aruch, siman תקצג, se'ifim beis, gimel. Are you allowed to talk between tekias d'meyushiv and tekias d'maumad for the bracha? That's a very big shaila. Go ahead. Yeah? Lo yasiach. You're not allowed to talk. What? Why? Because you need that the bracha should be chal alav. Buchacher, what are you going to do with this, no? A kind buchach, what are you going to do with this? Okay, we're still going to get to this. Let's see the Ramban now. למעשה, you don't have. Go ahead, Ramban. That is the Ramban. Now, do me a favor, read the Mishnah Berurah, se'if katan ches. Can I ask you a shaila? The gedolim that the Mishnah Berurah brought down in the Sha'ar HaTziyun, I mean, when they blew shofar in the morning, they made a bracha, right? What? And then what happened? They skipped Shacharis? I mean, what happened to the kriyas de'moed? I mean, what happened to the whole seder ha-tefillah and kriyas haTorah and everything? So you can come and say that Kriyas haTorah is not a hefsek, and the Shacharis is not a hefsek, and all this is not a hefsek to the bracha, because you're all one. They ... and ... and all morning, all day, and they... Okay? Otherwise, what happened to the bracha? Comes along the Chazon Ish, siman in Orach Chaim, siman קכ״ט, and he says it's mukhach from that little Mishnah Berurah, Sha'ar HaTziyun, from the gedolim, from the Sha'arei Teshuvah, that there's no din bracha on the second tekiyos. You don't have to make a bracha, because you see they blew in the morning, there's no bracha, it's finished, and still...

What happens? ... because you want the bracha to go. What's the nafka mina lahalacha? What happens if a person was mafsik? Whatever it is, he had hatzalah call, he disappeared, he came back. Now, or the other way around, he didn't have the kiyum of yishuv, only the kiyum of movement. Should he make a bracha? Bnei Yissaschar. Got the Bnei Yissaschar here. He has a shaylah in klal halacha, Bnei Yissaschar. Good shaylah. That if somebody didn't have the kiyum of yishuv, he only had the kiyum of movement, does he have to make a bracha? That's this kazayis. Maybe there's no din bracha on the kiyum of movement. Why? Why? Let's get the lomdus, because the whole chiyuv of kiyum is the yishuv. What's the kiyum of the movement? It's just to... Again, what, what, what? Oh, you see, right, the lomdus. L'maaseh, there's no takanah. That's a safek. There's no takanah for the kiyum of movement to have a bracha. Why? Because it's continuation. I am Bnei Yissaschar. No, because there was no takanah, because it's only said for the Shemoneh Esrei. I'll say the ... Heגר"א, it wasn't. That's what you say. But his safek is maybe it's only for the sake of the Shemoneh Esrei, that the Shemoneh Esrei should be, I'll say the ... What's the bracha? So what should he do? What should he do? Make a bracha and make a bracha? It's a kushya, I don't know. Al kol panim... No, I'm trying to tell you, I'm trying to explain to you, the bracha was for the kiyum of yishuv. The ikar bracha. So they takanah don't make a bracha. According to Mishnah... What is the ... from there, bracha to the moment? I'm telling you, all the Chazish said is what happened to the bracha in the morning. Teretz is the bracha in the morning. They only made one bracha in the morning. They made one in the morning. In the morning. But the question is, what happened to the moment once? The teretz is the moment doesn't need a bracha. The miyushim is the ones we make before the ... So they did that in the morning. They made the bracha in the morning. That's called miyush. How did that ...? How did that ...? ... They did also. I'm asking you, the ones that they did ... where was their bracha? That's what the Chazish said. That's what the Chazish מחדש, that the ones ... That's his chiddush. Again, you can't do a hundred ... in the ... Fifty of them have to be al seider ha-tefillah. There's no such thing. You have to have fifty al seider ha-tefillah. Where's the bracha? ... no bracha. So I'm showing you the ... even clarified so nicely that could be if a person didn't have the ... which means there's no bracha. He never made a bracha. He should make a bracha just for the ... Again, this ... Why? According to the ... it comes out the chiyuv is what? The ... The ... moment is only to say the tefillah. Are you allowed to eat in between? A hundred percent. You're allowed to be mafsik. That's the whole Chazish. There's no problem. There's no problem being mafsik. The only two issues is... Hatchila, but if you're hungry and you can't help it, you're allowed to be mafsik. I'm saying there's gedulah. If you don't have, if you have to, you'll ask, What are you, the bracha? Rabbi Akiva Eiger. In the teshuvas of Rabbi Akiva Eiger, he has something called takanos. He made takanos. You know Rabbi Akiva Eiger had a hospital. I don't know if you know that. You know Rabbi Akiva Eiger went to the hospital? Okay, let me tell you a little bit about Rabbi Akiva Eiger. Rabbi Akiva Eiger was a very interesting person. Tzanzer Rebbe, the Tzaddik of Brod, made a hospital in Laniado, the Laniado Hospital, Tzanz, in Eretz Yisrael. You know what—why was this story? He spoke about it when he invented the hospital, when the first groundbreaking, that when he was in the concentration camps, rachmana litzlan, that if he gets out, he'll make the hospital for people to save them al pi the dinei haTorah. It's going to follow mishpetei haTorah, a hospital al pi mishpetei haTorah. So he has rules and regulations, Shabbos, and a lot of it is about bein adam l'chaveiro, the respect you have to have for a patient, the love you have to have for a patient. Where did he get these halachos from? It was Rabbi Akiva Eiger. He took Rabbi Akiva Eiger's principles when Rabbi Akiva Eiger made a hospital. Rabbi Akiva Eiger made a hospital in Posen.

What happened was, Rebbi Akiva Eiger, a ksav. Yerusha from someone. It's a story about a yerusha, and someone left over money. He took the money, bought a building, and made a hospital. The hospital was run al pi dinei haTorah, according to Rebbi Akiva Eiger's psakim. And there was a whole beis din in the hospital how to pasken the she'eilos of the hospital. So he took, he took Rebbi Akiva Eiger's klalim and he instituted it in the Laniado Hospital. Al kol panim, Rebbi Akiva Eiger paskened that there was a mageifah one year in Posen, in the cities around where Rebbi Akiva Eiger lived. Rebbi Akiva Eiger paskened they should have tekias the miyushin, go home and eat and come back for tekias the amid. I'll say the ... This is the sugya, rabosai. Lefi zeh it comes out an interesting chiddush. Comes out an interesting chiddush. I asked you a she'eilah: should you or shouldn't you eat before tekios? So I'm telling you two klalim, besides for what it says in the Mishnah Berurah. Klal number one: there's no problem forgetting because the olam's eating there, so it's anyway not a problem. Klal number two—klal number two, we said—wait, no, wait, wait, wait. Oh, since the zman of the tekios is later anyway, meaning it's with the musaf, so there's no problem eating, but not like the shittah of this, of this ... Because according to ... , that's not docheh the musaf. The musaf and the eating and the ... is only nogea to the miyushim, not to the moments. So it's very difficult to say that it's when musaf, because it's not the musaf. That's what I'm telling you. It's not what I just said. So therefore the miyushim can't be, well it's later because of the musaf, because there's no—the miyushim is not docheh the musaf. And there's a problem of eating before the miyushim, and that's pashut the machlokes. Yeah, making— What about ... ? Why ... ? I do it because I do it. I'm a frum ... Why doesn't ... ? I am a frum ... Don't be ... What is frum ... ? I have a nice ...
